Former SABC COO Hlaudi Motsoeneng lost the bid to appeal the Gauteng High Court’s order to repay the 11 million rand he received from the former SABC board.
Former SABC boss Hlaudi Motsoeneng lost his bid to appeal a Gauteng High Court order to repay the 11.5 million rand “success fee” paid to him by the former SABC board.
The Supreme Court of Appeals (SCA) dismissed his appeal, with costs, for there being no prospect of success and for there being no compelling reason for the appeal.
Motsoeneng was paid by the former SABC board to negotiate a deal with MultiChoice for broadcast rights, including access to the public broadcaster’s archives.
In 2021, the high court overturned the board’s decision to pay Motsoeneng after ruling the payment was illegal and invalid.

The court gave him seven days to repay the money, with interest, and instructed the SABC Pension Fund to pay the amount to SABC or all of the pension income where the pension income does not amount to R11.5 million.
Motsoeneng then filed a request for leave to appeal, which was dismissed in July.
On Wednesday, the Special Investigative Unit (SIU) welcomed the dismissal of its appeal by the SCA.
“The SIU welcomes the Supreme Court of Appeals order as it paves the way for the unit to recover financial losses suffered by the SABC due to illegal and invalid decisions,” it said.
