The National Prosecution Authority (NPA) has appointed 25 prosecutors and 40 investigators to deal with cases stemming from the Truth and Reconciliation Commission (CVR).

NPA spokesman Mthunzi Mhaga said 64 cases had been registered for investigation.

He said this decision was the result of the NPA’s efforts to reopen cases emanating from the TRC. The NPA appointed lawyer Dumisa Ntsebeza SC to review her measures to deal with and prosecute these cases.

If Ntsebeza found evidence of a violation of the NPA Law, he would refer those cases to the National Director of Public Prosecutions (NDPP).

The NPA will also refer some matters for criminal investigation when necessary.

Mhaga said the decision was in line with a 2019 Gauteng High Court ruling in Johannesburg, which said the NPA needed to reassure the public that there would be no political interference when dealing with cases involving the TRC.

The court said: “Ultimately, there must be a public guarantee from the executive and the NPA that the kind of political interference that occurred in the CVR cases will never happen again. In this regard, they must indicate measures, including checks and balances”. , which will be put in place to prevent a repetition of these unacceptable violations of the Constitution.”

Mhaga said that Ntsebeza had three months to finalize his reports and recommendations.
