Brooks, a 19-year-old sophomore, died after being struck by a car in East Baton Rouge Parish in Louisiana in the early morning hours of January 15. On Monday, investigators announced they had arrested four men, including a 17-year-old boy. -aged, after two of them allegedly raped an intoxicated Brooks, while the other two were present, before leaving her shortly before they beat her.

In Louisiana, third-degree rape involves sexual intercourse that is “considered to be without the legal consent of the victim,” according to state law.

Visitation and funeral services will be held in Covington, Louisiana, on Friday, February 3.
A spokesperson for the East Baton Rouge Parish Sheriff’s Office told Fox News Digital that the person who hit Brooks is not facing criminal charges, adding that the person was “unaffected and contacted emergency personnel immediately.”

Documents related to the four arrests describe how the suspects and the victim had been drinking alcohol at a bar on Bob Pettit Boulevard, called Reggie’s, located about a mile from the LSU campus.
The four men left the bar with the victim, according to police records. Carver allegedly told police that Brooks “asked for a ride home.” “[H]He admitted that he agreed to take her because he didn’t want to leave her while he was heavily intoxicated and the bar was closing.”
Carver drove the vehicle, while Lee sat in the front passenger seat, Carver told police. Washington and the minor suspect sat in the backseat with Brooks, according to police documents. Carver told police that both Washington and the 17-year-old asked Brooks multiple times “if she wanted to have sex,” the affidavit says. She said she consented to her consent to Washington and the 17-year-old, but added that she “thought the victim was ‘drunk’ and slurred,” according to the affidavit.

He told police that he and Lee were still in the vehicle at the time of the sexual acts, the affidavit says, but that he “felt uncomfortable and ‘hated’ it,” the document added.
“During the interview, the co-defendant (Carver) was asked if the victim was too upset to consent to sexual intercourse and he responded, ‘I guess,'” the document continues.

Police records show that Brooks had a blood alcohol content of 0.319% at the time of his death.
Attorney Ronald Haley, who is representing two of the suspects, said the video showed Brooks “intentionally getting into the car,” according to FOX 8.

“It’s absolutely not rape,” he said. “Listen, this is a tragedy, it’s definitely not a crime.”
He acknowledged that Brooks appeared intoxicated, according to the report.
“To the point under the law that you say you’re in a state of intoxication, to the point that legally you can’t give consent or answer questions? That was absolutely not the case,” he said.

Haley further added that Brooks got out of the vehicle after an argument with the driver.
“She indicated that she was going to take an Uber,” Haley said. “I want the public to know that these youths or really the driver of the vehicle and the youths that were there did not pull it onto the side of the road.”

Ernest Legier Jr., commissioner of the Louisiana Bureau of Alcohol and Tobacco Control, told Fox News Digital on Tuesday that Reggie’s alcohol sales had been suspended while the agency continues to “investigate and share evidence about recent incidents at this establishment”.

“Due to the seriousness of the allegations and the potential threat to public safety, an emergency stay will be issued today,” Legier said. “This action immediately suspends the service or sale of alcoholic beverages at this location. An emergency hearing will be held next month to determine what penalties (if any) should be imposed following the presentation of the evidence.”
